1. Acceptance of Terms

By accessing or using the website located at risingroofservices.info, submitting an electronic service intake form, or placing a telephone call to our published customer dispatch line ((773) 207-0769), you acknowledge that you have read, understood, and agree to be legally bound by these Terms of Service. If you do not agree with any provision of these terms, you must immediately cease accessing this website and discontinue using our coordination services.

2. Independent Contractor Dispatch & Referral Model

Rising Roofers connects you with independent licensed roofing contractors who perform the work. Every roofer we send is licensed and insured in Florida.

Rising Roofers operates exclusively as a specialized marketing, customer intake, and dispatch referral entity serving homeowners and commercial property owners throughout South Brevard County, including Palm Bay, Melbourne, West Melbourne, Barefoot Bay, Sebastian, and Satellite Beach. Rising Roofers is not a direct roofing contracting firm, does not directly employ field installation crews, and does not pull municipal building permits in its own name.

When you submit a service request, we match you with an independent, third-party Florida-licensed roofing contractor who holds an active Certified Roofing Contractor (CCC) or Registered Contractor (CRC) license issued by the Florida Department of Business and Professional Regulation (DBPR). The formal construction contract, payment milestones, change orders, and workmanship warranties are executed solely between you (the property owner) and the assigned independent licensed roofing contractor.

3. Florida Statutory Insurance Claims Disclaimer (F.S. s. 489.147)

Mandatory Florida Statutory Consumer Disclosure:

Rising Roofers and its affiliated network of independent roofing contractors do not act as public insurance adjusters, do not negotiate insurance claims, and adhere strictly to Florida Statute s. 489.147 regarding insurance claims and advertising disclosures.

Under Florida law, only a licensed Public Adjuster licensed by the Florida Department of Financial Services or a Florida-admitted attorney may legally negotiate, adjust, or interpret policy coverage provisions on behalf of an insured policyholder. Neither Rising Roofers nor any affiliated contracting technician acts as a public adjuster.

Contractors provide purely factual, forensic damage observations, photographic proof, and itemized material cost scopes. Furthermore, Florida Statute s. 489.147 strictly prohibits contractors from offering to pay, absorb, rebate, or waive any portion of a homeowner's property insurance deductible. Homeowners remain entirely responsible for payment of their mandatory hurricane and all-other-perils insurance deductibles.

4. Prohibition of Assignment of Benefits (Senate Bill 2-A Compliance)

In accordance with Florida Senate Bill 2-A enacted by the Florida Legislature, post-loss Assignment of Benefits (AOB) for residential and commercial property insurance policies is eliminated across the State of Florida. You will never be asked to sign an Assignment of Benefits agreement through our network. All insurance claims, claim settlements, and contractor payment authorizations remain under the direct personal control of the property owner and any named mortgage lienholders.

5. Florida Construction Lien Law Notice (F.S. Chapter 713)

Under Chapter 713 of the Florida Statutes (Construction Lien Law), property owners who make improvements to real property must ensure that all material suppliers, subcontractors, and laborers who perform work are paid in full. When undertaking permitted roofing replacements exceeding $2,500 in value, homeowners must record a formal Notice of Commencement (NOC) with the Brevard County Clerk of the Court before work begins and obtain final Lien Waivers and Releases from the primary contractor upon completion.

6. Estimates, Scopes of Work, and Cost Benchmarks

All pricing guides, cost calculators, and material comparison tables published on this website are provided for general educational budgeting purposes only. Because roofing costs vary dramatically depending on roof slope, deck geometry, dry rot extent, structural accessibility, and Florida Building Code wind mitigation requirements, binding contractual quotes can only be provided after an on-site physical inspection. In severe weather conditions, live coordinators provide immediate interior containment guidance, and crews deploy the moment weather conditions permit safe physical stabilization.

8. Limitation of Liability & Indemnification

To the maximum extent permitted by applicable Florida law, Rising Roofers, its affiliates, directors, officers, and coordinators shall not be liable for any direct, indirect, incidental, punitive, or consequential damages resulting from the physical construction services, acts, omissions, or delays of independent licensed roofing contractors, nor for any property damage arising from severe acts of God, hurricanes, or lightning events. Property owners agree to hold Rising Roofers harmless from any claims arising out of contractor performance disputes.

9. Governing Law, Dispute Resolution & Brevard County Jurisdiction

These Terms of Service shall be governed by, construed, and enforced in accordance with the substantive laws of the State of Florida, without regard to principles of conflicts of law. Any legal action, claim, or proceeding arising out of or relating to these Terms or the use of this website shall be instituted exclusively in the state courts situated in Brevard County, Florida (Eighteenth Judicial Circuit of Florida).
